You will not share your account credentials with others or allow unauthorized access.

2.2. Security of Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, please notify us immediately at administrator@paleye.art.

We recommend enabling any available security options provided by your login provider (such as two-factor authentication) to keep your account secure.

2.3. Account Data and Management

Your Paleye account stores your saved color palettes, preferences, and related activity. You can request full data or account deletion by contacting administrator@paleye.art — and we will process your request manually as required by privacy regulations.

2.4. Account Suspension or Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms;
You engage in abusive or disruptive behavior;
You attempt to access the system in an unauthorized or harmful way.

If your account is terminated, your saved palettes and other associated data may be deleted in accordance with our Privacy Policy.

3. Acceptable Use & User Responsibilities

3.1. General Principles

By using Paleye, you agree to act respectfully, responsibly, and in good faith. Our platform is designed to inspire creativity through color exploration — not to be misused, exploited, or abused.

3.2. What You Must Not Do

You agree not to engage in any of the following activities while using the Service:

Misuse of the platform — attempting to disrupt, overload, or manipulate the system in any way.
Unauthorized access — trying to hack, bypass, or probe security mechanisms.
Data extraction or scraping — using bots, crawlers, or automated scripts to collect data, palettes, or images from Paleye.
Impersonation — pretending to be another person or organization, or using another person’s account without consent.
Inappropriate or illegal content — uploading or generating images, palettes, or prompts that are unlawful, hateful, violent, or sexually explicit.
Commercial misuse — using Paleye’s AI outputs or features for unauthorized resale, redistribution, or integration without prior written consent.

3.3. Intellectual Property and Attribution

All content, palettes, and materials available through Paleye — unless explicitly stated otherwise — are the property of Paleye.art or its licensors.You may use outputs (like color palettes) for personal or commercial design inspiration, but you may not represent Paleye’s system-generated results as your own proprietary work.

3.4. Responsibility for Your Activity

You are solely responsible for:

The content you upload or generate through Paleye.
Any interactions or sharing you perform within or outside the Service.
Compliance with applicable local laws regarding design, copyright, and AI usage.

If we receive a complaint or detect activity that violates these Terms, we may suspend or restrict your access without prior notice.

3.5. Reporting Misuse

If you notice suspicious, offensive, or harmful activity on Paleye, please report it to administrator@paleye.art. We take abuse seriously and will review all reports promptly.

4. Service Availability & AI Limitations

4.1. Service Availability

We strive to make Paleye accessible at all times, but we cannot guarantee uninterrupted operation. Occasional downtime may occur due to:

System maintenance or software updates;
Network or third-party service issues (e.g., Google login, analytics, or hosting providers);
Unexpected technical or security incidents.

Paleye reserves the right to modify, pause, or discontinue any part of the Service at any time without prior notice. We are not liable for any loss, inconvenience, or damage caused by such interruptions.

4.2. AI-Generated Content Disclaimer

Paleye uses artificial intelligence to analyze and generate color palettes, visual matches, and design suggestions. While we aim for accuracy and high aesthetic quality, AI-generated outputs may occasionally:

Contain imperfections or inconsistencies;
Misinterpret context, tone, or desired mood;
Produce results that differ from user expectations.

You acknowledge that all AI outputs are suggestions and inspirations, not professional design advice or absolute truth. We recommend verifying and refining results before using them in commercial or public projects.

4.3. Third-Party Dependencies

Paleye relies on secure integrations with external platforms (such as Google, Apple, and Microsoft for login authentication, and Google Analytics for usage metrics).

We do not control or take responsibility for the availability, performance, or privacy practices of these third parties.
Use of such services is governed by their respective Terms of Use and Privacy Policies.

4.4. Updates and Feature Changes

Our platform evolves continuously — features may be improved, replaced, or removed over time. We may also introduce new experimental features available in beta, which might not perform consistently or may change without notice.

By using Paleye, you agree to accept these updates and their possible impact on your experience.

5. User Accounts & Authentication

5.1. Account Creation

To access extended features of Paleye — such as unlimited searches and saving favorite palettes — you may create an account (“Account”) by signing in through Google, Apple, or Microsoft authentication. When you sign in, we collect your name and email address from your chosen provider to identify your account and enable secure access.

By creating an Account, you confirm that:

All information provided during sign-in is accurate and belongs to you;
You are at least 16 years old or have reached the legal age of consent in your country;
You agree to these Terms and our Privacy Policy.

5.2. Account Responsibility

You are solely responsible for all actions performed under your Account. Please ensure that access to your device and third-party login credentials (Google, Apple, or Microsoft) is secure and not shared with others. We are not responsible for unauthorized access caused by lost, stolen, or compromised login information.

5.3. Account Data

Your Paleye Account stores only essential information necessary for service operation:

Your login email (retrieved from Google, Apple, or Microsoft);
Your saved palettes and preferences.

We do not store your password or any sensitive credentials — authentication is handled entirely by the provider you choose (Google, Apple, or Microsoft).

5.4. Account Deletion

Currently, Accounts cannot be deleted directly from the user dashboard. If you wish to permanently delete your Account or any stored data, you can submit a request via email to administrator@paleye.art.

We will process your request promptly and confirm when your data has been removed from our systems. Future updates will include a “Delete Account” button for your convenience.

5.5. Account Suspension or Termination

We reserve the right to suspend or terminate your Account if:

You violate these Terms or misuse the Service;
Your actions disrupt other users or system stability;
Required by law or regulatory request.

Upon termination, your stored data may be permanently deleted, and your access to Paleye features revoked.

6. Privacy, Data & Cookies

You use Paleye at your own risk, and we recommend verifying any AI outputs before applying them in professional or commercial contexts.

7.2. No Professional Advice

All color palettes, design suggestions, and generated materials are provided for creative inspiration only. Paleye does not offer professional design, architecture, or psychological advice. Decisions based on our AI-generated results are your sole responsibility.

7.3. Limitation of Liability

To the maximum extent permitted by law, Paleye.art, its team, partners, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

Use or inability to use the Service;
Errors, inaccuracies, or omissions in AI-generated results;
Unauthorized access to your account or data;
Temporary unavailability or technical failures.

In no event shall our total liability exceed the amount (if any) paid by you to use Paleye.

11.1 Governing Law

These Terms of Use, as well as any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. If you access or use Paleye from another jurisdiction, you are responsible for compliance with all local laws that may apply.

11.2 Jurisdiction

All disputes arising from or related to the use of Paleye shall be subject to the exclusive jurisdiction of the competent courts. By using the Service, you agree to submit to the personal jurisdiction of these courts and waive any objection to venue or inconvenient forum.
